Terms of Service

1. Acceptance of Terms

By downloading and using AIPharmAccount ("Software"), you agree to be bound by these Terms of Service. If you do not agree, do not use the Software.

2. License Grant

Free Forever License: CloudAiSoft grants you a non-exclusive, non-transferable license to use AIPharmAccount for personal or commercial use of your pharmacy operations.

Restrictions: You may NOT:

• Reverse engineer, decompile, or disassemble the Software
• Modify, adapt, or create derivative works
• Sell, lease, transfer, or sublicense the Software
• Remove or alter copyright, trademark, or proprietary notices
• Use the Software for illegal or unauthorized purposes

3. Intellectual Property Rights

All rights, title, and interest in and to the Software are and remain the property of CloudAiSoft. The Software is protected by copyright laws in India and international copyright laws.

Your Data: You retain all rights to your business data (inventory, billing, etc.) stored in AIPharmAccount. We do not claim ownership of your data.

4. Disclaimer of Warranties

AS-IS BASIS: The Software is provided on an "AS IS" and "AS AVAILABLE" basis without warranties of any kind, express or implied.

CloudAiSoft does NOT warrant that:

• The Software will be error-free or uninterrupted
• The Software will meet your requirements
• Results will be accurate or reliable
• Defects will be corrected

5. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY INDIAN LAW: CloudAiSoft shall not be liable for:

• Loss of data or business
• Loss of profits or revenue
• Loss of use or goodwill
• Indirect, incidental, special, or consequential damages
• Damages from third-party services (Claude, Gemini, etc.)

Total Liability Cap: CloudAiSoft's total liability shall not exceed the amount you paid for the Software (which is $0 for free users).

6. Third-Party Services

AIPharmAccount may integrate with third-party services:

• Claude AI / Google Gemini: When you use AI features, you agree to their respective Terms of Service and Privacy Policies
• Ollama: Open-source LLM running locally on your machine

CloudAiSoft is NOT responsible for third-party services' availability, accuracy, or performance.

7. Data Backup & Loss

Your Responsibility: You are responsible for backing up your data. CloudAiSoft is not responsible for data loss due to:

• System crashes or hardware failures
• Accidental deletion
• Malware or security breaches
• Force majeure events

8. Acceptable Use

You agree NOT to use the Software for:

• Illegal activities or fraud
• Violating any laws (including pharmacy regulations)
• Harming others or their data
• Unauthorized access to systems
• Creating malicious code

9. Termination

Your license is granted indefinitely for free. However, CloudAiSoft may terminate your access if you violate these terms. Upon termination, you must delete the Software and cease use.

10. Changes to Terms

We may update these Terms of Service at any time. Continued use of the Software after updates constitutes acceptance of new terms.

11. Governing Law

Jurisdiction: These Terms are governed by the laws of India, specifically the Information Technology Act, 2000 and applicable Indian contract laws.

Disputes: Any disputes arising from these Terms shall be subject to the jurisdiction of courts in India.

12. Dispute Resolution

Before pursuing legal action, you agree to:

1. Contact CloudAiSoft via email at support@cloudaisoft.com
2. Attempt informal resolution within 30 days
3. If unresolved, disputes may be escalated to Indian courts

13. Indemnification

You agree to indemnify and hold CloudAiSoft harmless from any claims, damages, or liabilities arising from:

• Your use of the Software
• Your violation of these Terms
• Your violation of applicable laws
• Your data or content

14. Severability

If any provision of these Terms is found invalid under Indian law, that provision shall be severed, and remaining provisions shall remain in effect.
